§1 General Provisions
- These terms and conditions, hereinafter referred to as the "Regulations," define the rules for the provision of intermediary services in domain name registration and subsequent administrative and technical support of domain names, hereinafter collectively referred to as the "Service," by Smartx Technologies Ltd (referred to as Smartx Technologies or Intermediary), based in Cardiff, United Kingdom, at 7 Ty Nant Court, CF15 8LW, registered in the Companies House under number 12964587, hereinafter referred to as "Smartx Technologies."

§2 Definitions
- Registry - an entity managing the domain, performing registration and maintenance of names in that domain, and other activities related to domain names, in accordance with the regulations applied by the Registry.
- Registrar - an entity holding the status of an official domain registrar, accredited by the relevant Registry, which may act on behalf of the Intermediary as an intermediary between the Client and the relevant Registry.
- Service - the intermediary service in domain name registration and subsequent administrative and technical support of domain names provided by the Intermediary.
- Client - a natural person, legal entity, or organizational unit without legal personality, using the Intermediary's Services.
§3 Scope of Services
- Smartx Technologies is not a domain registering entity but, based on agreements concluded with Registries or Registry Partners, has the capability to mediate in the domain registration process.
- Smartx Technologies electronically intermediates in the contract conclusion procedure between the Client and the relevant Registry regarding the registration or renewal of a domain name.
- Smartx Technologies' services in domain registration, renewal, and support include:
- Posting Registry offers on the Smartx Technologies website at: https://smartxhosting.uk/.
- Enabling the submission of domain name orders via the website https://smartxhosting.uk/ and through the Client Panel.
- Transmitting orders to the relevant Registry.
- Obtaining and providing information regarding the contract conclusion procedure in the field of domain name registration.
- By placing an order for domain registration, the Client authorizes Smartx Technologies to transmit the Client's order to the appropriate Registry or Registry Partner authorized to register the given domain. If the Client expresses a desire to renew the domain, the Client authorizes Smartx Technologies to transmit the relevant information to the appropriate Registry or Registry Partner. This authorization also includes obtaining and receiving, on behalf of the Client, domain authorization information in the form of an AuthInfo code and transferring domain service provided to the Client to another Registry Partner.
- The regulations of Registries and Registry Partners and their privacy policies are available on their websites. Links to those documents are published in the Annex no 1.
- In accordance with the rules of domain registration and due to Registry requirements, the data of the user registering the domain will be transmitted by the Registries to the WHOIS database.
- Until the user begins using the domain, Smartx Technologies reserves the right to place information on the domain address indicating that the domain has been registered through Smartx Technologies and that technical support is provided by this company. This information may include the Smartx Technologies logo and a link to their website.
- The Client grants Registry Partners power of attorney to perform, on their behalf, activities related to the registration, maintenance, change of holder, deletion of the domain, and management of domain data.
- The Client also grants power of attorney to Smartx Technologies to perform these activities when the company obtains the status of a Registry Partner. The Client agrees that Smartx Technologies may carry out all legal activities related to the registration and maintenance of the domain.
- The Client grants Smartx Technologies consent and power of attorney to perform all necessary activities related to the registration and maintenance of the domain, including obtaining an AuthInfo code and transferring domain service to another Registry Partner.
- This power of attorney also applies when Smartx Technologies becomes a Registry Partner and intends to transfer domains from another Registry Partner.
- These powers of attorney enable the execution of orders and instructions submitted by the Client within the framework of the services, ensuring their optimal implementation.
- Smartx Technologies does not guarantee the registration or renewal of a domain name. The registration or renewal is solely dependent on the decision of the relevant Registry.
- Smartx Technologies will request the registration of the domain name from the relevant Registry upon receipt of the payment from the Client as specified in the order summary or at another time resulting from the rules established by the Registry.
- After placing an order for domain registration, the domain is not reserved. The "first come, first served" principle applies. Smartx Technologies will register the domain within 24 hours of receiving the paid order. The payment date is not the reservation date of the domain, and Smartx Technologies does not guarantee its availability at the time of payment.
- Smartx Technologies has the right to refuse the registration of a domain when:
- The domain is already registered.
- The Registry refuses to register the domain based on its regulations (links to Registry regulations are available on the website https://smartxhosting.uk/legal-acts/).
- The domain name contains illegal content.
- The domain name is on the list of reserved or blocked domain names in the Registry's regulations.
§4 Terms of Service Use
- The Client is obliged to provide true and current data necessary for the provision of the Service.
- The Client is obliged to comply with the provisions of these Regulations and the regulations of the relevant Registries.
- Smartx Technologies reserves the right to refuse to provide Services in the event of a breach by the Client of these Regulations or the regulations of the relevant Registries.
§5 Liability
- Smartx Technologies is not responsible for the actions and omissions of Registries, including the refusal to register or renew a domain name.
- Smartx Technologies is not responsible for damages resulting from the malfunctioning of teleinformatics systems beyond the control of Smartx Technologies.
- Smartx Technologies is not responsible for:
- Blocking or deleting the domain name by the Registry and its potential occupation by a third party.
- Registering a domain name in bad faith.
- Claims made to a given domain name by third parties.
- Making changes to the domain name configuration or deleting the domain name by an unauthorized person as a result of the Client providing login, password, or account access data to third parties.
§6 Final Provisions
- Smartx Technologies reserves the right to make changes to these Regulations. The Client will be informed of any changes to the Regulations by publishing a new version of the Regulations on the Smartx Technologies website.
- These Regulations are part of the Smartx Technologies Regulations available on the website: https://smartxhosting.uk/legal-acts/.
- In matters not regulated by these Regulations, the laws in force in the United Kingdom apply.
- The Regulations come into force on the date of their publication on the Smartx Technologies website.
