Regulations on resignation – withdrawal from the contract

§1 Introduction

This policy delineates the rights and obligations of our customers concerning resignation and withdrawal from contracts within the 14-day cooling-off period, in accordance with the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013.

§2 Right to Withdraw

1. If you have entered into this Agreement as a consumer, you are entitled to cancel your contract with Smartx Technologies within 14 days of the contract formation date.
2. The withdrawal period concludes 14 days after the contract is formed. For clarification, the contract is established when you place an order through our website confirming you have read the Regulations, thereby granting us permission to commence your services.

§3 Expections to Withdrawal and Refunds Rights

1. As soon as the services have commenced, you will not have the right to cancel the contract under the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013. If you do not wish to waive this right, you will not be able to place an order and we will not be able to commence your services.
2. Domain name registrations/purchases are not covered by the Consumer Contracts (Information, Cancellation, and Additional Charges) Regulations 2013.
3. SSL certificates, domain privacy protection, premium services and software licenses are not eligible for refunds.
4. If you use the services in the course of business, you will be treated as a non-consumer, and statutory consumer protection will not apply to this Agreement.

§4 How to Withdraw

1. To exercise your right to cancel, you must inform us of your decision to cancel this contract by a clear statement.
2. You may use the model withdrawal form provided below, but it is not obligatory. Please contact us through Support menu in Customer Portal.

§5 Commencement of Services During the Cooling-Off Period

If you request that we begin the performance of services during the 14-day cooling-off period, you acknowledge and agree to the following terms:

1. Partial Performance: If you agree to the service starting within the 14-day cancellation period, Smartx Technologies will charge you for any services you have received up until the point of cancellation. The charges will reflect the value of the services provided.
2. Full Performance: If the service is provided in full within the 14-day period, you will lose the right to cancel, as the service will have been completed before the cooling-off period elapses.

§6 Effects of Withdrawal

1. If you cancel this contract, we will reimburse all payments received from you, except for the costs outlined below:
   1. Costs of services already provided at your request during the cooling-off period.
   2. Services excluded from cancellation refund as given in point 2.
2. Reimbursement will be made without undue delay and not later than 14 days after the day on which we are informed about your decision to cancel this contract.
3. We will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise. Reimbursements via the same means of payment as used for the initial transactions are free of charge. If you request reimbursement via a different means, you agree to bear all charges incurred. We will deduct these charges from the total refund amount.

§7 Commencement of Services

1. If you request that services begin immediately within the 14-day cooling-off period, you acknowledge and agree that you will be liable to pay for the value of the services provided up to the point of cancellation.
2. If the services are completed within the 14 days, the right to withdraw will be lost.
