Terms and conditions of the privacy protection service for domain

§1 Introduction

1. These Terms and Conditions ("Terms") govern the use of the WHOIS Privacy Protection Service ("Service") provided by Smartx Technologies Ltd ("Smartx Technologies") and their domain registrars.
2. By using the Service for your domain(s), the user ("Registrant") agrees to comply with these Terms.
3. The Service is available exclusively for the following domain extensions: .com, .net, .org, .biz, .info.

§2 Service Description

1. Scope of Service: The WHOIS Privacy Protection Service is designed to protect the personal information of the registrant from being publicly disclosed in the WHOIS database, in accordance with ICANN regulations.
2. Availability: The Service is optional and can be applied to new domain registrations as well as existing domains registered through Smartx Technologies. The Service is available exclusively for the domain extensions listed above.
3. Activation: The Service can be added as an additional option when purchasing the domain, if it is available.
4. Renewal: If the Service was added during the registration of the domain and is still available, Smartx Technologies will automatically extend it upon domain renewal.
5. Deactivation: If the registrant no longer requires the Service, they should contact Smartx Technologies through the Client Panel.

§3 Registrant Responsibilities

1. Control and Ownership: The Registrant retains full control, ownership, and legal responsibility for the domain name. Using the Service does not transfer ownership or control of the domain to Smartx Technologies or its registrars.
2. Accurate Information: The Registrant agrees to provide and maintain accurate and up-to-date registration information, including name, postal address, email address, and phone number. The Registrant guarantees the accuracy of this information.

§4 Rights and Obligations

1. Right to Suspend or Terminate the Service: Smartx Technologies reserves the right to suspend or terminate the Service at its discretion, without liability to the Registrant. This may occur in cases of misuse of the Service or if the Registrant provides inaccurate, false, or outdated information.
2. Disclosure of Information: In the event of a Uniform Dispute Resolution Policy (UDRP) procedure or a "cease and desist" order directed to the Registrant, Smartx Technologies and its registrars reserve the right to disclose the Registrant's hidden data associated with the domain name.

§5 Legal and Financial Liability

1. Indemnification: The Registrant agrees to release, defend, indemnify, and hold harmless Smartx Technologies, its subsidiaries, affiliates, agents, directors, officers, and employees, along with its domain registrar, from any claims, demands, liabilities, losses, damages, or costs, including reasonable attorney's fees, arising out of or related to the domain registration, the privacy services provided, and/or the use of the domain name registration.
2. Registrant Liability: The Registrant is fully liable for the registration and use of the domain name, ensuring that it is used exclusively for lawful purposes.

§6 Abuse and Infringement Reporting

1. Reporting Abuse: Third parties wishing to report abuse of the WHOIS Privacy Protection Service or infringement of trademarks or other rights should send an email to office@smartxtechnologies.com.

§7 Final Provisions

1. Changes to the Terms: Smartx Technologies reserves the right to modify these Terms at any time. Continued use of the Service after such changes constitutes acceptance of the new Terms.
2. Governing Law: These Terms are governed by and construed in accordance with the law of the United Kingdom, without regard to its conflict of law principles.
